The family of a 69-year-old woman is suing an Elgin nursing home for failing to protect her from an alleged sexual assault by a 21-year-old mentally ill resident. Chicago attorney Pete Flowers said Tuesday it’s the most flagrant example of nursing home negligence he’s seen. He says the facility’s administrator tried to cover up the brutal attack by calling it consensual sex. The lawsuit seeks at least $50,000 in damages and was filed in Cook County Circuit Court Monday on behalf of a resident identified only as Jane Doe. It names as defendants Maplewood Care nursing home, S.I.R. Management and the facility’s former administrator, James Doyle. Ron Nunziato, vice president of the management company, says he has no comment on the lawsuit or the alleged attack. ______ Copyright 2009 Associated Press. All rights reserved.
